I have had a condition for nearly 15 years that I have trouble documenting as the simple fact is that one does not routinely lay claim to the many small injuries that may or may not add up to one big one. Given the duration I wouldn't be too hopeful.

Ollie Desalvo: I have MS and am on long term disability. Regardless of their decision, if they DO make you pay back everything, they'll just shaved about $50 ea month off your disability pymts. Trust me, I know b/c I'm still paying them back. Also, they don't tell you this, but you CAN work 9 cumuliative months and still get your disability, if you are still working, you lose it, but you can be put right back on it w/in 5 years w/o reapplying if found still disab! led. Also...they don't tell you this either: you can work and make approx $980.00 gross monthly and still cont to get your full disability check ea month w/o worrying you are going to lose it. Also, they can have waiting periods before that condition can be covered.I don't know when your policy was effective so I can't say more. But I would, for sure, tell them that these injuries were from the second time you fell and it had NOTHING to do with the first set of injuries.They are going to try and relate your second accident to your first one so you won't be covered.It's a confusing deal. Elvie Drumgoole: The first slip was a pulled muscle. You were treated and returned to work. No big deal, you acted as a dedicated employee willing to go back to work. The second slip and fall is the result of employer negligence and is a separate case. The legal fact is, your employer knew there was a condition that existed with equipment that was defective. Your second injury was due to negligence on the part of your employer for not repairing or maintaining the machine. You should call OSHA and request an investigation and retain a work injury lawyer to protect your interests. You are indeed a victim here. Nevermind the greedy Insurance company. Cody Petrulis: I'! m sure they'll try to say you had a preexisting condition because these companies don't want to pay out LTD or easy for a person to get it.Doesn't sound like preexisting condition to me - a pulled muscle is very different than lumbar damage requiring spinal surgery. Frankly, with the stakes so high, I'd consult an injury or medical experienced attorney, most will give an initial consultation at no charge. Arnulfo Seegars: The pre-existing condition would have to deal with your back/vertebrae or staph infections. If your pulled muscle was in your back, they may try to use that as a pre-existing condition. If it was in your l! eg or arm, then I don't see how they could consider that as a pre-exist! ing condition to your back troubles and the resulting staph infections.BTW, that pulled muscle must have been REALLY bad to go to the hospital for it!
