Nedra Oltz: You would do well to document your condition. Anything less is an uphill struggle. I have had a condition for nearly 15 years that I have trouble documenting as the simple fact is that one does not routinely lay claim to the many small injuries that may or may not add up to one big one. Given the duration I wouldn't be too hopeful.
Chadwick Schmelz: Any condition for which you were diagnosed and would require further treatment in the future would be considered a pre-existing condition.
Ollie Desalvo: I have MS and am on long term disability. Regardless of their decision, if they DO make you pay back everything, they'll just shaved about $50 ea month off your disability pymts. Trust me, I know b/c I'm still paying them back. Also, they don't tell you this, but you CAN work 9 cumuliative months and still get your disability, if you are still working, you lose it, but you can be put right back on it w/in 5 years w/o reapplying if found still disab! led. Also...they don't tell you this either: you can work and make approx $980.00 gross monthly and still cont to get your full disability check ea month w/o worrying you are going to lose it. If I had had the advice given to me I just gave you, OMG...there would've been so much less hardship. goodluck....Show more
Cedric Grimstead: If the condition happened after you were insured, you should be covered
Dawn Saha: A condition that you had before the effective date of your policy. Also, they can have waiting periods before that condition can be covered.I don't know when your policy was effective so I can't say more. But I would, for sure, tell them that these injuries were from the second time you fell and it had NOTHING to do with the first set of injuries. They are going to try and relate your second accident to your first one so you won't be covered. It's a confusing deal. Email me if you want with more details. Like effective date of policy, etc. ! ...Show more
Elva Batie: Pretty well anything. The! y are a profit-making enterprise and it will be up to you to prove it wasn't "preexisting." They will look through your medical records and anything even a broken toe could be considered a prexisting condition.
Elvie Drumgoole: The first slip was a pulled muscle. You were treated and returned to work. No big deal, you acted as a dedicated employee willing to go back to work. The second slip and fall is the result of employer negligence and is a separate case. The legal fact is, your employer knew there was a condition that existed with equipment that was defective. Your second injury was due to negligence on the part of your employer for not repairing or maintaining the machine. You should call OSHA and request an investigation and retain a work injury lawyer to protect your interests. You are indeed a victim here. Nevermind the greedy Insurance company. You have a legitimate case for employer negligence causing you permanent harm....Show more
Cody Petrulis: I'! m sure they'll try to say you had a preexisting condition because these companies don't want to pay out LTD or easy for a person to get it.Doesn't sound like preexisting condition to me - a pulled muscle is very different than lumbar damage requiring spinal surgery. Frankly, with the stakes so high, I'd consult an injury or medical experienced attorney, most will give an initial consultation at no charge. The SIC will probably use the tactic that your first accident caused the damage followed by an exacerbation of the injuries by the second fall. Was this a home accident or did it occur somewhere else....Show more
Marvel Mcaulay: Yes that is a pre-existing condition. The condition occured before you got the insurance..that is pre-existing.
Arnulfo Seegars: The pre-existing condition would have to deal with your back/vertebrae or staph infections. If your pulled muscle was in your back, they may try to use that as a pre-existing condition. If it was in your l! eg or arm, then I don't see how they could consider that as a pre-exist! ing condition to your back troubles and the resulting staph infections.BTW, that pulled muscle must have been REALLY bad to go to the hospital for it! Sorry!...Show more
